These are the terms and conditions on which we sell our products to you via our website, https://ohmycream.co.uk. The publication director is Mrs. Juliette Lévy. Oh My Cream organizes, under the conditions defined below, a free giveaway without any obligation to purchase entitled "Energy Rise x Oh My Cream Giveaway" from Tuesday, September 24th 2024 (9 AM) to Tuesday, September 1st 2024 (11:59 PM), as part of the promotion of its products.
ARTICLE 2 - ACCESS CONDITIONS TO THE GIVEAWAY
The game is open to any legal adult resident in the United Kingdom, excluding employees of the organizing company and members of their immediate family (direct line relatives such as ancestors and descendants) or collateral relatives, their spouse, concubine, or registered partner.
Failure to comply with the participation conditions outlined in the rules will result in the nullity of the participation.
The organizing company reserves the right to carry out any necessary verification concerning, in particular, the identity, age, and address of each participant, to enforce the provisions of these rules.
ARTICLE 3 - PRIZES
One winner will be awarded the following prize:

- An in-store Plumping Facial (worth £90) and an Infrared Sauna Session (worth £45).
ARTICLE 4 - TERMS AND CONDITIONS OF PARTICIPATION

Complete the participation form with all mandatory information and click on "Participate".
Responses sent through any other means (private message, email, etc.) will not be accepted. Only one participation per person will be considered.
ARTICLE 5 - PRIZES ALLOCATION
The organizing company will conduct a random draw among participants who have completed the form to select one (1) winner. The winner's name will be announced on September 2nd, 2024, by sending an email to the winner, who will be requested to provide their details (full name and postal address) within seven (7) days via email to the organizing company. If the winner does not respond within this timeframe, they will be considered as having forfeited their prize.
The organizer commits to dispatch the prizes by regular mail within six (6) weeks following the transmission of the winner's details (the postmark being considered proof).
Prizes that cannot be delivered due to reasons beyond the control of the organizing company (incorrect address, no response from the winner, etc.) will be forfeited permanently and cannot be reassigned.
The winner cannot claim the cash equivalent of the prize or request its exchange for other goods or services for any reason. Prizes also cannot be transferred to third parties.
In the event of force majeure or if circumstances require, the organizing company reserves the right to replace the won prizes with other prizes of equivalent nature and value, without this leading to any compensation or indemnity of any kind.
The organizer cannot be held responsible for delays, losses, and/or damages to the prize during its shipment.
ARTICLE 6 - DISPUTES AND LIABILITY
Participation in the game implies unconditional acceptance of the regulations in their entirety. Any inaccurate or false statement, or any fraud will result in the disqualification of the participant. No telephone or written requests regarding the interpretation or application of these regulations, the mechanics or modalities of the game, as well as the winner, will be answered.
The organizing company reserves the right to pursue, by any means, any attempt to circumvent these regulations, particularly in the case of providing incorrect information. The responsibility of the organizing company cannot be sought for all incidents that may occur due to the use of the awarded prizes. Oh My Cream will not be responsible for any malfunction of the Internet network preventing access to the game or its smooth running.
In all other cases, in the event of a dispute or claim, requests must be submitted to Oh My Cream within a maximum of fifteen (15) days after the close of the game (postmark being proof), by regular letter, addressed to the "Customer Service." This letter must indicate the precise date of participation in the game, the complete contact details of the participant, and the exact reason for the dispute. No other form of dispute or claim will be considered. The decisions of the organizer are final: Oh My Cream is the sole authority to settle any questions regarding the application of the regulations. The game and the interpretation of these regulations are subject to British law.
ARTICLE 7 - EXPENSES REIMBURSEMENT
For participants using an Internet connection billed by the connection time, the Internet connection for participating in the game will be reimbursed upon simple written request to the address of the organizing company, with proof and on a flat-rate basis of €0.16 including VAT per minute.
Given the current state of service offerings and technology, some Internet service providers offer free or flat-rate connections to users. In these conditions, participants are informed that any access to the game made on a free or flat-rate basis (such as cable connection, ADSL, etc.) will not be subject to any reimbursement, because the subscription to the services of the Internet service provider is contracted by the user for their overall use of the Internet, and the fact that participants connect to the Facebook social network and participate in the game does not incur any additional charges.
Postal expenses incurred for the reimbursement request will be refunded based on a standard postage stamp rate (less than 20g) in effect on the date of this game. To obtain a refund for their connection costs and the postage costs of their reimbursement request, participants must send a written request to the organizing company within a month of incurring these costs (postmark being proof). This request, written on plain paper, must contain the following essential elements:

Full name and personal postal address accompanied by an official proof of identity, as well as a bank account statement.

The supporting invoice with clearly highlighted dates, times, and durations of connection.
The organizing company will reimburse these costs by bank transfer within two (2) months following the receipt of the participants' request.
ARTICLE 8 - PERSONAL DATA
Winners have the right to access, rectify, and delete their data upon a simple written request addressed to the game's address.
People who exercise the right to delete their data before the end of the operation will be deemed to waive their participation.
The organizing company Oh My Cream and its partner Energy Rise are the only recipients of the information collected, and this information will not be used for commercial prospecting purposes or transmitted to other commercial partners without the prior consent of the participants.
